Conformity declaring

Conformity declaring is carried out by the manufacturer, or a person authorized by the manufacturer, or by the seller (supplier) by adopting a declaration on the basis of evidential materials.
The requirements to the composition of evidential materials are established by the technical regulation of the Republic of Belarus or the technical regulation of the Eurasian Economic Union, and in cases where the technical regulations of the Republic of Belarus or technical regulations of the Eurasian Economic Union are missing, or if they do not specify the composition of evidential materials, they are established by the rules of conformity attestation.
The specific range of persons accepting declarations of conformity with the technical regulations of the Eurasian Economic Union is established by the technical regulations of the Eurasian Economic Union.
The specific range of persons accepting declarations of conformity may be limited by the technical regulations of the Republic of Belarus, or normative legal acts of the President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus providing for the introduction of mandatory conformity attestation with the view to take prompt measures of state regulation, or by the rules of conformity attestation, taking into account the specifics of the conformity attestation object, conformity attestation schemes used in the conformity declaring, within the general range of persons accepting declarations.
The person accepting the declaration is responsible for the eligibility for accepting the declaration, including the existence of such a right to accept it, the completeness and accuracy of the information contained therein, and the existence of necessary evidential materials as a basis for this declaration.
Conformity attestation schemes applied during the conformity declaring are established by the relevant technical regulation of the Republic of Belarus, technical regulation of the Eurasian Economic Union and other law of the Eurasian Economic Union, and in cases where technical regulations of the Republic of Belarus and technical regulations of the Eurasian Economic Union are missing, or the schemes of conformity attestation with the technical regulation of the Republic of Belarus are not specified, they are established by the rules of conformity attestation.
The declaration is subject to registration in the declaration registration bodies.
The manufacturer or its authorized person, or the seller (supplier) is entitled, instead of product conformity declaring, to choose to certify this product, if such an opportunity is provided for by the technical regulation of the Republic of Belarus or the normative legal act of the President of the Republic of Belarus or the Council of Ministers of the Republic of Belarus providing for the introduction of mandatory conformity attestation with the view to take prompt measures of state regulation, or by the technical Regulation of the Eurasian Economic Union.
