In accordance with the Law of the Republic of Belarus "On Architectural, Urban Planning and Construction Activities in the Republic of Belarus" of July 05, 2004. No. 300-З, control and supervision in the field of construction activities is conferred to the state construction supervision bodies.

The state construction supervision is an integral part of the state regulation system of construction activities in the Republic of Belarus and is carried out in order to ensure operational reliability and safety of construction projects, as well as compliance with the established procedure for the construction of the projects, and state protection of the consumers interests of construction products and society.

The state construction supervision is carried out for the projects of construction, reconstruction, development, restoration, and capital repair (hereinafter referred to as construction), regardless of their purpose, form of ownership, funding sources and construction methods, with the exception of dacha and horticultural construction projects, as well as projects, the construction of which does not require obtaining permits for the  construction and installation operations, as well as projects and types of works controlled by other state supervision bodies in accordance with the legislation of the Republic of Belarus.

The main task of the state construction supervision bodies is to monitor the compliance with the requirements of the legislation of the Republic of Belarus, normative-technical and approved design and estimate documentation by investing party, carrying out construction in order to ensure operational reliability and safety of construction projects

The unified system of the state construction supervision bodies consists of:

Department for construction control and supervision of the of the State Committee for Standardization;

Inspection Board of the Department by regions and Minsk, task-oriented Inspection Board of the Department.

The powers of the state construction supervision bodies

The state construction supervision bodies in accordance with the legislation:

• carry out control at the projects, the construction of which requires obtaining the permits for the construction and installation operations, whether the customers and building owners have the documents provided for by the legislation of the Republic of Belarus;  
• as well as register the construction projects and keep their records;
• control the compliance with the requirements of technical normative legal acts in construction, approved project documentation when performing construction and installation operations, as well as compliance of materials, products and structures used in construction with design options and certificates to ensure operational reliability and safety;
• issue the conclusions within their competence on the conformity of projects accepted for operation, project documentation, to the safety requirements and operational reliability;
• make proposals to the local executive and regulatory bodies and, if necessary, to the relevant state bodies, on changes in the reporting data on putting into operation  the construction facilities in case of violation of the procedure for their acceptance into operation;
• participate in the work of Investigation commissions on circumstances of construction accidents;
• send to the Ministry of Architecture and Construction the proposals to terminate the qualification certificates and conformity certificates;
• consider appeals of individuals and legal entities on matters within their competence;
• issue opinions on draft technical regulations and other technical normative legal acts;
• interact, if necessary, with the republican bodies of state administration and other state organizations subordinate to the Government of the Republic of Belarus, with the local executive and regulatory bodies, other organizations when addressing issues within their competence;
• exercise other powers provided by the legislation.

The powers of the state construction supervision bodies

The state construction supervision bodies have the right to:

• freely access all projects under control, regardless of their purpose, form of ownership, funding sources and construction methods upon presentation of service certificates and order to conduct the inspection, and as regards the projects with the restricted access in accordance with the legislation – upon presentation also of other documents provided for by the legislation for the access to such a projects;
• receive from customers, building owners, contractors, project documentation developers the design, technological and executive documentation necessary for exercising the powers conferred to the state construction supervision bodies without compensation and without restrictions;
• give the customers, building owners, contractors, developers of project documentation the mandatory instructions to comply with to eliminate violations committed during construction, to conduct random openings at their own expense for inspection, examination of separate units and components of the building, installations and constructions, additional testing of soils, materials, engineering systems, surveys, measurements;
• make sampling of materials and products for laboratory testing and examination;
• contract on a paid basis specialists from research organizations to participate in the control of compliance with the mandatory requirements of technical normative legal acts by participants of the construction activity, as well as in conducting construction and technical expert review;
• exercise other powers provided by the legislation.

The state construction supervision bodies suspend, forbid the operations at construction projects in case of:

• detection of defects and (or) violations that create the threat of deformation or collapse of buildings, installations, their separate units, engineering services, structures;
• carrying out of unauthorized construction or construction with deviation from the approved project documentation.

The state construction supervision bodies make the submission to customers, building owners, contractors, developers of project documentation, organizations producing construction products about:

• bringing to responsibility the office holders violating the legislation in the field of construction activities and not complying with the instructions of the state construction supervision bodies;
• suspension from work of contractor office holders at construction projects who systematically fail to ensure compliance with the mandatory requirements of the technical normative legal acts and project documentation, as well as workers who are not performing satisfactorily quality control of operations, technical supervision and construction design supervision;
• non-compliance of building materials and equipment with mandatory requirements of technical normative legal acts and the requirements on the prohibition of their use in construction.

In accordance with the Code of Execution Procedure of the Republic of Belarus on administrative violations, the state construction supervision bodies act as the body conducting the administrative process, register, keep records of administrative violations and convey information on violations to the internal affairs bodies in the prescribed manner.
